1. Agreement to Terms

These Terms of Service (“Terms”) are a binding agreement between you and AI Tech Magic LLC, a Wyoming limited liability company, doing business as Living Algorithm (“Living Algorithm,” “we,” “us,” or “our”), governing your access to and use of the website at www.livingalgorithm.com and all related features, content, and services (collectively, the “Service”).

By accessing or using the Service, creating an account, or subscribing to a paid plan, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account or purchase a subscription.

2. ⚕️ Important Health and Medical Disclaimer

Please read this section carefully. It is a fundamental part of these Terms.

Living Algorithm provides educational and informational content only, including information about herbs, plants, traditional and ancestral practices (including practices rooted in Haitian and Caribbean herbal traditions), rituals, and general wellness. This content is offered for general informational and cultural purposes.

The Service does not provide medical advice. Specifically, you acknowledge and agree that:

• The information, suggestions, plant identifications, symptom-related responses, ritual guidance, and any other content provided through the Service are NOT medical advice, diagnosis, or treatment, and are NOT a substitute for the advice, diagnosis, or treatment of a qualified, licensed healthcare professional.
• Always seek the advice of a licensed physician, pharmacist, or other qualified healthcare provider with any questions you may have regarding a medical condition, symptoms, medications, pregnancy, nursing, or before starting, stopping, or changing any health regimen, herb, supplement, or practice.
• Never disregard professional medical advice or delay seeking it because of something you read or received through the Service.
• Herbs and plants can be powerful. They may be toxic, may cause allergic or adverse reactions, and may interact dangerously with medications or with each other, or be unsafe during pregnancy, nursing, or for certain individuals or conditions. Information provided through the Service may be incomplete or may not apply to your situation.
• You are solely responsible for any decisions or actions you take based on content from the Service, and for verifying the identity, safety, sourcing, preparation, dosage, and appropriateness of any plant, herb, or practice before use.
• The Service is not intended to diagnose, treat, cure, or prevent any disease. These statements have not been evaluated by the U.S. Food and Drug Administration or any equivalent authority.

If you are experiencing a medical emergency, call your local emergency number or seek immediate in-person care.

By using the Service, you accept all risk associated with the use of any information obtained through it.

3. The Service and AI Features

The Service includes features such as a plant/herb archive, a plant-identification tool, a symptom-to-suggestion tool, a ritual builder, a personal ritual journal, and related content.

Some features are powered by artificial intelligence. When you use these features, the inputs you provide (such as text, selected herbs, or uploaded photos) are processed by a third-party AI provider to generate a response. You understand and agree that:

• AI-generated content may be inaccurate, incomplete, or unsuitable for your situation, and must not be relied upon as professional advice of any kind (including medical advice — see Section 2);
• You are responsible for evaluating the accuracy and appropriateness of any AI-generated output before relying on it;
• You will not submit through these features any content that is unlawful, infringing, or that you do not have the right to submit, and you should not submit information you would not want processed by a third-party AI provider (see our Privacy Policy).

We may modify, add, or discontinue features of the Service at any time.

4. Accounts

To access certain features, you must create an account. You agree to:

• Provide accurate and complete information;
• Keep your password confidential and secure;
• Be responsible for all activity that occurs under your account;
• Notify us promptly at hello@livingalgorithm.com of any unauthorized use.

We may suspend or terminate your account if you violate these Terms.

5. Subscriptions, Billing, Cancellation, and Refunds

a. Plans

The Service offers a free tier (“Seedling”) and paid subscription tiers, currently:

• Grove — $197 a year
• Sacred Circle — $397 a year

Prices, features, and plan names may change; we will provide notice of material changes as required by law. Current pricing and features are shown on the Service.

b. Billing

Paid plans are recurring subscriptions billed in advance on an annual basis (or another billing period shown at the time of purchase) through our payment processor, Stripe. By subscribing, you authorize us (via Stripe) to charge your payment method on a recurring basis until you cancel. Your subscription will automatically renew each billing period unless you cancel before the renewal date.

c. Cancellation

You may cancel your subscription at any time. When you cancel, your subscription will remain active until the end of your current paid billing period, after which it will not renew and you will lose access to paid features.

d. Refunds

All payments are non-refundable. Except where required by applicable law, we do not provide refunds or credits for partial billing periods, unused time, or subscription fees already paid.

e. Taxes

You are responsible for any applicable taxes, which may be added to your charges where required.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms;
• Submit content that is illegal, infringing, harmful, harassing, or that you lack the right to submit;
• Attempt to gain unauthorized access to the Service, other users’ accounts, or our systems;
• Interfere with or disrupt the Service, or attempt to circumvent any access, security, or subscription controls (including paywalls or tier restrictions);
• Scrape, copy, resell, or redistribute the Service’s content except as expressly permitted;
• Misuse AI features (for example, to generate unlawful content) or use automated means to overload or abuse them.

We reserve the right to investigate and take appropriate action against violations, including suspending or terminating accounts.

7. Intellectual Property

The Service, including its design, text, graphics, original content, and software, is owned by AI Tech Magic LLC or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use, subject to these Terms.

Your content. You retain ownership of the content you create or submit (such as your saved rituals and reflections). By submitting content, you grant us a limited license to store, process, and display it as necessary to provide the Service to you.

8. Disclaimer of Warranties

The Service and all content are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any content (including AI-generated content or herbal and wellness information) is accurate, complete, or reliable.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.

9. Limitation of Liability

To the maximum extent permitted by law, in no event will AI Tech Magic LLC, its owners, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of (or inability to use) the Service or any content, whether based on warranty, contract, tort, or any other legal theory, even if we have been advised of the possibility of such damages.

To the maximum extent permitted by law, our total liability for all claims relating to the Service will not exceed the greater of (a) the amount you paid us in the twelve (12) months before the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).

Nothing in these Terms limits liability that cannot be limited under applicable law (such as liability for death or personal injury caused by negligence where the law does not permit its exclusion).

10. Indemnification

You agree to indemnify and hold harmless AI Tech Magic LLC and its owners and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your content, or your violation of these Terms or of any law or third-party right.

11. Governing Law and Disputes

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws rules. Subject to any rights you may have under mandatory local law, you agree that any dispute arising out of or relating to these Terms or the Service will be resolved in the state or federal courts located in Wyoming, and you consent to their jurisdiction.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice, including for violation of these Terms. Upon termination, your right to use the Service ceases. Sections that by their nature should survive termination (including disclaimers, limitations of liability, intellectual property, and governing law) will survive.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date. If we make material changes, we will take reasonable steps to notify you. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.
